USFQ Gana Concurso de Litigio ante el Sistema Universal de Derechos Humanos

Equipo que representó a la USFQ
La Universidad San Francisco de Quito (USFQ) ganó el Concurso de Litigio ante el Sistema Universal de Derechos Humanos. Ana Morales, Roberto Eguiguren, Sebastián Abad, Carlos Paredes, estudiantes del Colegio de Jurisprudencia, y Daniela Salazar, profesora del Colegio y entrenadora, integraron el equipo que representó a la USFQ. Adicionalmente, el estudiante Roberto Eguiguren recibió los premios de mejor orador del concurso y mejor orador de la ronda final. En esta competencia participaron también equipos de la de la Universidad de las Américas, Universidad Católica de Ibarra, Universidad de Cuenca, y Universidad Central del Ecuador. 

El Concurso de Litigio ante el Sistema Universal de Derechos Humanos se desarrolló entre el 23 a 27 de agosto de 2016 en las instalaciones de la Universidad San Francisco de Quito y se trató de la primera edición de esta competencia que se perfila como una nueva oportunidad para explorar un sistema protector de derechos humanos cuyas herramientas permanecen desconocidas por los abogados litigantes. El concurso fue organizado por el Colegio de Jurisprudencia de la Universidad San Francisco de Quito, con el apoyo de Freedom House y USAID. El empleo del Sistema Universal de Derechos Humanos como base de este concurso pretende brindar innovación, diversidad y beneficios prácticos, así como el crecimiento académico y profesional de sus participantes. 

Conversatorio con Catalina Botero
La dinámica del concurso permite tratar una temática distinta cada año, relacionada con cada uno de los órganos de supervisión existentes dentro del Sistema Universal de Derechos Humanos. En la primera edición, el caso hipotético se relacionó con el derecho a la libertad de expresión y la publicidad de los procesos judiciales, el cual fue simulado ante el Comité de Derechos Humanos de Naciones Unidas. Una parte esencial de la competencia es que la autoría del caso hipotético recae en una persona de alto renombre en el ámbito del Derecho Internacional de Derechos Humanos, con grandes aspiraciones de colaborar con las simulaciones académicas. La autora del caso de la primera edición del concurso fue Catalina Botero – ex Relatora especial sobre Libertad de Expresión de la Comisión Interamericana de Derechos Humanos y  magistrada auxiliar de la Corte Constitucional de Colombia- quien también fue jueza de la ronda final y protagonizó un interesante conversatorio sobre los retos actuales de la libertad de expresión en Ecuador donde participaron alumnos, académicos y periodistas. El conversatorio con la autora del caso hipotético permitió a los participantes del concurso reconocer que los puntos desafiantes que se encuentran establecidos en el caso hipotético no son ajenos a la realidad y, por ende, la competencia es un punto de partida para perfeccionar herramientas académicas conducentes tanto al conocimiento como a la práctica litigiosa en el ámbito de los derechos humanos.

Los paneles de jueces de las rondas preliminares de la primera edición del concurso estaban compuestos por abogados litigantes, profesionales expertos en Derechos Humanos, profesores del área, miembros de ONGs, así como ex participantes de concursos de simulación. Los jueces de la ronda final de la primera edición del concurso fueron Catalina Botero, Juan Carlos Calderón –periodista del portal PLAN V-, Claudia Storini –coordinadora del doctorado en derecho de la Universidad Andina Simón Bolívar- y Gabriela Panchana –activista de medios electrónicos y política-.

El Concurso de Litigio ante el Sistema Universal de Derechos Humanos es el resultado de un proyecto de alumnos de Jurisprudencia y ex participantes de concursos de simulación de litigio. La primera edición fue organizada por el Colegio de Jurisprudencia de la Universidad San Francisco de Quito, con el apoyo de Freedom House y USAID.

EL OSO ANDINO, UNA ESPECIE PROTEGIDA POR LA LEGISLACIÓN AMBIENTAL

¿Osos en Quito? Una osa de anteojos con sus dos cachorros llamó la atención de turistas, rescatistas y personal del Teleférico de Quito el pasado fin de semana vistos en las faldas del volcán Rucu Pinchincha en busca de comida. Estos páramos, bosque nublados y bosques subtropicales forman parte de las 65 mil hectáreas  que involucra 5 parroquias rurales: Calacalí, Nanegal, Nanegalito, Nono y San José de Minas bajo el Corredor Ecológico de Osos Andino del Distrito Metropolitano de Quito declarados como tal y que corresponde al 16% del territorio rural del Distrito.

Normalmente estos osos pasan la mayoría de tiempo atrás del Pichincha donde se conservan grandes territorios de páramo y suelen moverse hasta llegar a los bosques nublados del noroccidente. El oso de anteojos el único úrsido que existe en América Latina y es endémico de los Andes de Venezuela, Colombia, Ecuador, Perú, Bolivia, y el norte de Argentina. Se encuentra amenazado por la destrucción de su hábitat y por la cacería. Las amenazas para su supervivencia son la tenencia informal de la tierra, el uso desordenado del suelo y las prácticas agropecuarias extensivas que derivan en varios conflictos entre humanos y osos llegando a prácticas como la cacería. La carretera Calacalí- Nanegalito-La Independencia que atraviesa el noroccidente del DMQ actúa como una barrera al normal desplazamiento de osos y otros mamíferos grandes que arriesgan su vida al cruzarla o simplemente no lo hacen, pero esta limitación puede comprometer la salud genética de la población de osos al impedir el intercambio de genes entre individuos de un lado de la carretera con aquellos del otro costado. De los 2.000 que se estiman existen en el Ecuador, en el Distrito se han registrado 50  en el noroccidente de la capital que están siendo monitoreados e investigados  bajo el Programa de Conservación del Oso Andino de la Secretaria de Ambiente del DMQ y la USFQ para salvaguardar de la extinción a esta especie emblemática de Quito y la biodiversidad asociada que habita en el Corredor del Oso. 


Estos animales son silvestres, es decir, viven sin contacto con seres humanos y están catalogados como amenazados a nivel local y regional. La legislación que los protege es amplia, la Constitución ecuatoriana del 2008 (art. 400) que declara como interés público a la biodiversidad silvestre; el Texto Unificado de Legislación Secundaria de Manejo Ambiental, Libro IV de la biodiversidad del  2003 (art.103) que prohíbe la cacería de esta especie amenazada o en peligro de extinción, y la reciente incorporación de normativa en el Código Orgánico Integral Penal del 2014 (art.247) que protege a esta especie y lo cataloga como delito contra la flora y fauna silvestre aquella persona que cace, pesque, capture, recolecte, extraiga, tenga, transporte, trafique, se beneficie, permute o comercialice, especímenes o sus partes, sus elementos constitutivos, productos y derivados, de flora o fauna silvestre terrestre, marina o acuática., de especies amenazadas, en peligro de extinción y migratorias, listadas a nivel nacional por la Autoridad Ambiental Nacional y tratados internacionales ratificados por el Estado, cuya sanción es la pena privativa de libertad de uno a tres años.  Esta especie, el oso andino o llamado más carismáticamente oso de anteojos consta en el libro rojo de mamíferos del Ecuador desde el 2011.

A nivel local, desde el 2008 el Municipio del DMQ ha generado información suficiente para emprender acciones que aportan significantemente en el manejo del hábitat de la especie en esta zona del Distrito, así como Resoluciones del Concejo Metropolitano para la declaración del oso andino como especie emblemática de Quito en el 2012,  la creación del Corredor en el 2013, y la creación del Programa de Conservación del Oso en el 2015 con el fin de emprender proyectos de acción pública, privada y comunitaria para salvaguardar a esta especie en conjunción con la Autoridad Ambiental Nacional, la Policía Nacional y otros gobiernos autónomos con la finalidad de consolidar una red de vigilancia y monitoreo para prevenir su captura, comercialización, transporte y caza ilegal dentro de su jurisdicción. 

Las marcas de las caras de estos animales son únicas e irrepetibles, como las huellas dactilares en los seres humanos, por lo que llaman la atención y enamora a quienes observan a los osos de anteojos. Su importancia, su protección y manejo ha hecho que Quito sea la sede de la XXV Conferencia Internacional de Osos respaldada por International Bear Association (IBA) a realizarse en noviembre de 2017 donde se espera a más de 300 científicos, biólogos y especialistas en el tema de todo el mundo.

The Colegio de Jurisprudencia de la Universidad San Francisco de Quito invites applications for the first and second semester of the academic year 2016/2017

Starting from this academic year, law professors of the Colegio de Jurisprudencia de la Universidad San Francisco de Quito have the possibility to visit Hungary and spend two weeks in one of the most prestigious law schools of the country! In the framework of the Erasmus+ “International Credit Mobility” Program professors have the chance to teach and enhance cooperation with the Law School of PPCU, while all the expenses are paid by the Program!
I. General Information
·         In order to apply for the program, you should be a full-time, part-time or adjunct professor of the Colegio de Jurisprudencia de la Universidad San Francisco de Quito.
·         You should be willing to undertake to teach 3x1,5 hours per week for 2 weeks in your research field in English.
·         Erasmus + Program grants you financial support for your travel expenses and for the living expenses, according to the following:

II. Who is eligible?

III. What do you need to apply?

IV. The evaluation
The evaluation of the applications is based on the instructions of the Erasmus+ Program, which was founded by the Education, Audiovisual and Culture Executive Agency (EACEA) of the European Commission. “The selection of participants, as well as the procedure for awarding them a grant, must be fair, transparent and documented and should be made available to all parties involved in the selection process.”
On the basis of these requirements, we take into consideration the following factors.

  •    full-time, part-time, or adjunct professor of USFQ Law School
  •    CV and cover letter
  •    language skills
  •   interest in academic and university life, and chances to cooperate and strengthen the relationship with PPCU
Advantages:
  •    previous teaching or research experience in English or legal courses completed in English
  •    achievements and perspective in the scholarly field;
  •    scientific and other academic results;
  •    participation and lecturing in international conferences
  •    foreign educational organizations.
  •    if you have not yet had the possibility to participate in international programs

In case it is necessary for the evaluation, the applicant will be invited to a personal interview.
The professors selected for the Erasmus+ Program will have to sign an agreement to continue teaching at the USFQ Law School for at least one year after the end of the Program.

V. Important notes:
  •     You need to indicate if you apply for the first or the second semester!
  •   If you would like to apply for the first semester, you can choose the scholarship period (2 weeks) to be whenever between September 5th and December 17th in 2016
  •    If you would like to apply for the second semester, you can choose the scholarship period (2 weeks) to be whenever between February 7th and May 15th in 2017
  •     The application deadline for both semesters is: September 15, 2016
  •    We accept only those applications that are complete, arrive in time and are in line with every formal and substantial requirement, stressed out here.
  •     A committee, set up by the USFQ Law School and the Office of International Programs, will choose the two best applications.

Call for Students and Professors
to join the
Constitutional Reasoning Research Group




Objectives
Concerns regarding the lack of coherent and well-founded judicial decision-making seem to be present in every constitutional culture. Even in countries, where constitutional review is a highly esteemed institution of the constitutional system with long history, the reason-giving practice of the courts, and especially the high courts have been in the focus of scholarly attention and critics. Moreover, in many countries the widely acknowledged importance of giving a consistent, well-founded justification is still lacking. One way of raising the awareness about the importance of reasons and justification in legal decision-making, lies in the hands of scholars, through confronting the judges with their mistakes or inconsistencies in their reason-giving practice. The most effective democratic control of the courts is publicity. Public pressure can make a change if there is an ongoing public debate that is supported by responsible and objective critical opinions formed in good faith about the practice of courts. A deep analysis of the reasoning and the interpretation of the courts’ jurisprudence is needed for authentic and responsible public debate. However this area is still under-researched. Therefore the Research Group aims at starting a scientifically and theoretically grounded research that is focused on the most important decisions of the Ecuadorian Constitutional Court.
The Research Group is going to explore what reasons exactly are given to justify CC decisions, what type of interpretation the CC uses, what is the nature of the reasoning the decisions contain and what general patterns are possible to be drawn from these findings. In order to guarantee the availability of our research, to raise the level of publicity and through this to contribute to the quality of the public debate, we would like to publish our results online. This intention of ours corresponds to the underlying purpose of the project, which is to contribute to the common good through the support of a responsible and honest public debate.

Method
In order to increase the authenticity of our results, the Research Group will use both descriptive methods based on empirical data and theoretical, prescriptive analysis. We are going to research Constitutional Court decisions from every field of law, trying to deal with those that represent the highest capacity of relevance for the research. The Research Group lays emphasis not only on the strictly understood legal and constitutional aspects, but opens up to political, philosophical and language issues as well. Therefore we intend to cooperate with other relevant faculties, as well as other universities in this project.
The Research Group aims at functioning in two languages, in Spanish and in English. On the one hand Spanish is indispensable for gathering and researching CC decisions, and also to help the constitutional dialogue, which is basically in Spanish. However, in the scholarly field the research could have a considerably greater potential if the results are published in English as well. By using English as a working language we can enter the comparative constitutional discourse more effectively, where Ecuador could gain more representation.

Practical information
The members of the Research Group are primarily students and professors of the Law School of Universidad San Francisco de Quito. Secondarily, the Research Group is open for professors of other faculties and other universities too. The ongoing tasks and the time schedule of the project will be discussed in the regular meetings of the Research Group; the date of the first, founding meeting is going to be specified by email as we approach the beginning of the academic year 2016-2017.
The scope of the researched CC decisions, the research method, the tasks to be assigned and the time scale of the research project will be specified soon after the compound of the Research Group is fixed.
